Withdrawal Notice (Widerrufsbelehrung)

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (M&R Technologies UG (haftungsbeschränkt), An der Strusbek 12, 22926 Ahrensburg, Germany, email: moin@songmania.me) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.

In order to meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

If you withdraw from this contract, we will reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in no event will you be charged any fees for such reimbursement.

Every purchase — the single purchase of one version, the bundle of both and the later subsequent purchase of the second version — is a separate contract for digital content not supplied on a physical medium; this notice applies to each of those contracts. Immediately before completing payment, you make two declarations using a mandatory checkbox — in Stripe Checkout, or when paying via PayPal on the song page before the PayPal window opens: you expressly consent to Songmania beginning to provide your song before the end of the withdrawal period, and you confirm that you know your 14-day right of withdrawal expires once performance begins (§ 356 (6) of the German Civil Code, BGB). Neither payment can be completed without this checkbox, and no purchase is concluded.

As soon as the payment provider (Stripe or PayPal) confirms payment, we immediately unlock the purchased version, both purchased versions, or the second version added later, without a watermark for playback and download. Performance then begins and the right of withdrawal expires subject to the statutory requirements. For payments via Stripe, Stripe sends the receipt or invoice to the email address captured in Checkout; for payments via PayPal, Songmania sends a purchase confirmation to the email address you gave when creating the song. In each case it serves as confirmation of the contract in text form and records that you consented before paying and acknowledged the expiry (§ 312f (3) BGB).

Until that moment you can withdraw, and an informal declaration to moin@songmania.me is enough; no particular form is prescribed. A permanently available electronic withdrawal function (“Withdraw contract”) presupposes, under § 356a (1) BGB, that the withdrawal period is running. Since unlocking follows payment confirmation automatically and your right of withdrawal expires with it, no period remains afterwards in which such a function could take effect. We therefore do not provide one.

If unlocking fails in an individual case, or if your right of withdrawal does not expire for some other reason, it continues to exist unchanged. You then exercise it by the route named above under “Right of withdrawal”, and we will confirm receipt to you.
